Employees weren’t treated well, and tbh, students weren’t treated great, either. We were told via Instagram that our classes were postponed. INSTAGRAM. I don’t even have Instagram on my phone. Followed by an email about theater and training center closure 4-5 days later. It all seems incredibly sloppy, and this just adds to that narrative.

Hey. As you can guess, Daryl's legal claim would be laughed out of court within seconds and he may very well be ordered to pay attorney fees and such. It's a howler, and I seriously doubt he can get any lawyer to file the claim on his behalf.

IF HE DOES, reach out to me. I defended a UCB performer against libel & slander claims on a pro bono basis during the Aaron Glaser crap and can explore doing so again (need sign-off from my firm--literally the #1 litigation firm in the world--but I expect I can get it).

Legally, Daryl really has no case for defamation. Defamation cases require false statements targeted specifically at the plaintiff resulting in real personal damages, and this just didn't happen. As a law student his arguments are pretty laughable - especially when he tried to say it was libelous to share his own tweets. oof. Anyway, UCB workers deserve better!

Whatever school gave you a journalism degree should be ashamed of itself, because this is incredibly unprofessional conduct. This entire piece should have been one sentence "I emailed UCB CFO Daryl La Fountain, for comment, but have not received a reply". You're a buffoon.

One doesn't get paid for your unused sick days when you get laid off or quit a job. You don't. No one does. That line of questioning is a non-starter, and destructive. Just because Amy Poelher has money -- did she make that money from the USB? Because if USB can't support itself -- which it sounds like it can't -- I don't think she is required to dig into her own separately earned pocket to add to the money that she has already obviously put in. There are things that she could do or organize or donate, but really it's up to her. Seth's questions are all wrong, very bloggy, very entitled, without understanding what it takes to run a nonprofit or even a business, and I fear they create a hostility that makes any kind of reach out or fundraising show or other support less likely than more. All laid off employees are entitled to Unemployment Insurance, which is a benefit fund that was paid into by their employer USB. And they got all got their unused PTO. Putting Daryl's name out there made him and his family a target for people who are looking to get outraged. And, so, no, Seth, you aren't reporting, you are commenting about something so very narrowly that is not for the greater good. Creatives need outlets, and 160 employees is a lot. Casting USB in a bad light damages USB which damages a creative job-creator. There may be people who are unhappy there, but the sick leave pay-out is not illuminating that. You come across as battering and agenda-driven -- which is not reporting -- using a very limp bat.

I’m not so sure about this scene... it seems like you both entered the scene with an initiation/idea, and you both kept trying to get the other to join each other’s game. Then again on the one hand, you offered a game you could both play, and he wouldn’t play... when you offered to play a game that maybe he wanted, he still wouldn’t play.

I’d say you should both go back to to class, maybe back to Improv 201 for you and Improv 101, then 201 for him.
